Terms & Conditions


Confirmation of your booking by the payment of a deposit / full amount is a legal commitment to acceptance of these Terms and Conditions so please ensure you read them carefully before making your booking. We recommend that you arrange your own cancellation insurance to provide cover in the event of unforeseen circumstances causing you to cancel your booking.
Terms & Conditions.

Contract

The contract effected on confirmation of reservation relates to a holiday let only and is therefore not an assured tenancy in terms of Housing (Scotland) Act 1988. This confers on the client the right to occupy the property for the period agreed for holiday purposes only, in terms of Schedule 4 Section of the aforementioned Act.

The Owner   
The owner of the property is Oleum Associates Ltd, with registered office at 16 Crombie Acres, Westhill. AB32 6PR. Company No 291 531. VAT no 126 7421 22.

The Hirer (Principle Renter)  

The hirer (Principle Renter) is the person who makes the booking and must be aged 30 or older. Rentals will not be accepted in respect of any client under 30 years old. 
The hirer is responsible for all occupants and their guests. The owners reserve the right to refuse rentals or terminate a rental for improper use or unacceptable behavior. The number of persons occupying or visiting the property must not, at any time exceed 12 (adults or children) plus 2 infants, either during the day or at night. Stag or Hen parties and weddings are not permitted and no temporary structures (tents, marquees, portable hot tubs etc) are to be erected on the grounds. Birthday parties and family / friends gatherings are permitted. If the party size exceeds the maximum occupancy of the property, the let will be terminated early, with no refund. 

The hirer may not sublet all or part of the accommodation to a Third Party. If this is found to be the case, the Third Party will have no legal right of occupancy and will be required to vacate the property.

The hirer is responsible for the condition of the property and its entire contents during the hire period (see Breakages Deposit Below).

The Hirer undertakes to leave the hired premises secure if left unoccupied during the period of let.

Reservations & Bookings. 
 
Provisional reservations are held for 24 hours. Thereafter a booking must be confirmed and followed up with the payment of a Non Refundable Booking Deposit of 25% (or full payment if within 6 weeks of rental date).   

The balance is due in full no later than six weeks prior to your arrival date.

If you are booking less than 6 weeks from the rental date the full amount is payable (last-minute bookings are payable in full through our online booking system).
The booking deposit is non refundable (25%), as is the balance (75%) if within six weeks off arrival.  

Non-payment by the due date will be treated as a cancellation and the owners may re-let the property without reference to the Client.

Cancellations
 
Booking cancellations must be confirmed in writing.

Deposits (and payments made within 6 weeks of rental date) are non-refundable, and the balance is still payable on the due date.

The owners will make every effort to re-let the property and if successful, will be pleased to refund the applicable portion less a £50 administration fee.

Extraordinary Circumstances
 
If the owners have to cancel your booking for any reason owing to events out with their control (examples bellow), a full refund will be given immediately:

• Destruction of property due to flood, fire, earthquakes or acts of God;
• That the property is inhabitable due to irreparable damage or on Health & Safety issues that could not reasonably have been foreseen;
• Sale or withdrawal of the property

The owners will have no further liability to the visitor or to any other party.. 

Insurance
 
Cancellation and Curtailment Insurance: It is strongly recommended that insurance be taken out for all bookings. Having to cancel your holiday for whatever reason is hard enough but the loss of Deposit or total rental can come as an additional setback. To minimise this unfortunate occurrence you should take out Holiday Insurance. When you reserve the property you are entering into a legally binding contact. If you are unable to take your holiday property, then you will be liable to pay a Cancellation Charge and this could amount to the total cost of your holiday.

Holiday Insurance: As well as Cancellation and Curtailment Insurance clients are strongly recommended to take out holiday insurance to cover loss or damage to personal effects. Under no circumstances can the owner of the property be held liable for any loss or damage to clients’ property. Further information, about holiday insurance, can be found in banks, Post Offices, building societies and from the providers of your home and car insurance. As far as the law allows, the owners take no responsibility for loss, damage, injury or illness to the hirer, any of the party or visitors during the occupancy period arising from any causes whatsoever. In making the booking you agree to indemnify the owners against loss, damage or injury sustained to the property or persons from any deliberate or negligent act or omission by the hirer or any member of the party. The owners cannot accept responsibility for any personal property belonging to the hirer and their visitors. All vehicles and property are left at the persons own risk. 

Coronavirus (COVID-19) 
 
CORONAVIRUS - guests travel to the property and enter the property at their own risk. Any symptoms and transmission of the virus must be reported to ourselves as the property owner and the NHS. Self isolation will not be permitted and guests will be asked to leave the property immediately if it is safe for them to do so. Any extended stay will be charged for at the tariff for the relevant week. Refunds will only be given in the event of travel restrictions preventing arrival to the property. In this event a 100% refund will be made. Refunds will be considered on a pro rata basis if the property has to be vacated early. 

Booking Period
 
The booking period is from 4 p.m. on the day of your arrival to 10 a.m. on the morning of your departure unless otherwise agreed. Accommodation bookings are from Saturday (7 nights) during our High Season (April to October, Xmas, New Year) and Friday to Monday (3 Nights) during our Low Season (November to March, excluding Xmas, New Year). Dates might change to suit holidays ie Easter, October school week and Xmas New Year. If you would like to request different entry dates please make contact and we will try to accommodate you. 

Breakage Deposit 

As part of the booking process a payment for a refundable breakage deposit of £500 is required. This is due as per the terms of the payment of the balance and will be refunded to the same payment method within 14 days. Any damages or excess cleaning will be deducted from the deposit. 

The Breakage Deposit: The breakage deposit is a security bond made between the hirer (Principal Renter) and the property owner (Oleum Associates Ltd), which is taken on the understanding that the hirer will take care of and cause no damage to the property rented during their stay. Any difficulties or complaints while staying should be directed to ourselves as the property owner. The hirer (principal renter) agrees that the Breakage Deposit will be taken at the time of final payment or that any damages costs incurred can be debited from the Debit/Credit card used to make final payment. We as the property owner undertake to return the Breakage Deposit (or balance there-of) within 14 days of vacation or satisfaction of any remedial works required to meet the hirers obligations in respect of the condition of the property (whichever is the later).  

Damage: If there are any “accidents” or breakages during your stay please make a note and leave in the property for the housekeeper. You will be required to pay for replacements. The property will be cleaned before you arrive and it is expected that the private ownership of the property will be respected and that it will be left in a decent order for the next guests. Any extra cleaning charges incurred as a result of your stay will be automatically passed on to the hirer (Principle Renter). 

Maintenance
 
You may receive a visit from a tradesperson for general maintenance, grass cutting and window cleaning. You will be notified of the day they expect to be onsite and are not required to be present. The tradesperson will be given the keysafe number to gain entry. If you are not happy with this arrangement, we as owners must be notified in order to make alternative arrangements.  

Children
 
Children are very welcome. Parents are responsible for the safety and supervision of any children staying or visiting the property at all times. Children under the age of 14 must not be left unsupervised in the property. 

Pets
 
Family pets are very welcome but must sleep in their own beds, not those at the property. Pets are not allowed on the furniture and a small extra cleaning charge of £35 per pet. A maximum of 2 dogs are allowed to stay. Dogs should not be left unattended, must be kept on a lead and prohibited from fouling areas around the property. Any fouling must be cleaned up by the Dog’s owner.  

Smoking
 
There is a no smoking policy within the property. 

Candles
 
Due to the high fire risk, candles are not allowed in the property.

Bed Linen / Towels
 
Bed linen and towels for maximum occupancy are provided in the property. 

Logs
 
Two baskets of logs are provided as part of your stay and included in the rental fee. While access to additional logs is provided, this is not a contractual obligation. Guests are also expected to provide their own firelighters and kindling. 

Utilities 
 
Any failure of Utility Services to the property, e.g. electricity, water supply, waste water services, TV signal, Wifi, refuse collection or log delivery by third party suppliers which is totally beyond the control of the lodge owners, we cannot be held responsible in any way. However, if you need to vacate the property as a result of a failure of one or more supply or service failure(s), a refund equal to the amount of the days remaining of your holiday will be paid. 

Complaints
 
Every effort has been made to ensure that you have an enjoyable holiday. If, however, you have cause for complaint, we are anxious that remedial action is taken as quickly as possible. It is essential you contact the owners so that any complaints can be speedily resolved. No compensation will be made or correspondence entered into in connection with complaints raised after the property has been vacated. 

The owners reserve the right to terminate the contract at any time or to remove person or persons due to unreasonable behaviour or damage to the property that may cause annoyance or offence to other parties. In such cases any refund will be at the discretion of the owners. The owners reserve the right to enter the property at any reasonable time. 

The owners reserve the right to alter or improve any of the subjects and amend or update our prices, and website without notice. In case of any discrepancies please be sure to check directly with the owners. All rights reserved.  

Privacy Notice 
 
We retain information about you and your booking in our database, this consists of your name, address and contact details as well as the property you have booked or reserved and payment dates. We retain some payment information until the booking process - including bond refund - is complete and it is then destroyed. This is done two weeks after your departure. We will only pass on any identifiable information about you if it is in connection with your booking and is absolutely necessary - eg. to rectify a maintenance issue. We have guidelines in place in relation to GDPR. Your data is stored securely on our booking platform Freetobook. If you opt into our mailing list we will use your information for our own marketing purposes only. Our mailing list is held and processed by Mailchimp.  

Terms & Conditions
 
We reserve the right to change or amend these terms and conditions at any time. In addition, we reserve the right to change any of the specification of the property at any time.
